KARACHI: A sessions court has ordered the SHO of Sachal police to provide protection to the residents of a housing society in Scheme 33 in Malir, who were allegedly facing attempts to illegally occupy their land by private persons.
The residents of Gahusia Cooperative Housing Society had filed an application before Additional District and Sessions Judge (Malir) Syed Ghous Ali Shah Jillani under Sections 22-A and 22-B, seeking directions to provide them protection and register a case against the private persons allegedly involved in illegally occupying the land of the society with the help of the SHO Sachal and issuing threats to force the residents to vacate.
After examining the report filed by the SHO and hearing the applicants’ counsel, the court ordered the SHO of Sachal police to provide legal protection to the applicants under Article 4 of the Constitution.
The court noted that the counsel for the applicants stated that his clients would be satisfied if an order for legal protection was given to them.
“Therefore, SHO PS Sachal, Karachi, is directed to provide lawful protection to petitioners and ensure that no harassment shall be caused to the petitioners. This order will not be used as a shield for petitioners for any legal proceedings,” the judge wrote in the order while disposing of the application.
According to the applicants, the private persons are allegedly harassing them with the help of the SHO Sachal and issuing threats to vacate the houses of residents in the society and supporting the proposed accused in illegally occupying the land.
They claimed that prior to the application, they had moved an application to the SHO Sachal against the private persons; however, the SHO did not take any action.
“The petitioners approached the SHO and also moved an application to the SSP Malir for protection of their lives but the proposed accused are still issuing threats to the petitioner.”
The applicants urged the court to record their statements under Section 154 of the CrPC and to restrain the proposed accused persons and their companions from harassing, humiliating, pressurising and blackmailing them.
