Rs800,000 fine for ‘extramarital affair’

SUKKUR: A Jirga (tribal court) held in Ghulam Nabi Nandwani village near Tangwani town of Kandhkot-Kashmore district on Wednesday ordered a man to pay a fine of Rs800,000 after finding him guilty of having an extramarital affair with a woman.

The Jirga proceedings, presided over by Wadera Dadan Nandwani, which were attended by a large number of Nandwani community members, besides the aggrieved family and that of the suspect, Rehan Nandwani.

After hearing both sides, the Jirga found Rehan Nandwani guilty and ordered him to pay a fine of Rs800,000 to the aggrieved family. His family paid Rs100,000 on the spot and undertook to pay off the remaining amount within the next three months.

We hear so frequently about this jirga or that jirga - can our governments, both Federal and Provincial take some effective measures to stop such unlawful and regressive practices? Or our Governments want us to continue with old tribal traditions, and they do just a lip-service that such practices will be effectively stopped.

If it was a woman found guilty, she would have been killed in the name of honor. That's how injustice Jirgas are towards women. Please ban Jirgas

It says affair, not rape. How is the woman "aggrieved", and what dictates this sort of punishment? Its not in Pakistan's constitution, nor is it part of Islamic law.

Aggrieved family to be paid 800k? I wonder who is *aggrieved" here. Did the accused physically did some assault or what. The news says it was extra marital affair. Was it one sided affair by the man by "force"?

As compared to other Jirga , this one seems to have settled the matter with light punishment, which is ,in a way, welcome. Jirga(benevolent) is an voluntary & accepted forum which provides quick resolution of community disputes which otherwise would never be settled & would ruin the concerned parties financially & emotionally- given the attitude of the police& situation in our courts. I believe Panchiat system is sanctified in Local Government system. Besides, our judicial system is overloaded.

To commentators below, questioning if it had been a woman, the punishment would have been harsher. Note: The man obviously was having an affair with another woman in this case - and not with a goat. So, in this instance, it seems the jirga did not punish the woman for having an affair with another man, that too someone who was married.

In my opinion this Jirga system is way better than existing Court system cause the cases in courts takes decades to reach a verdict. However, the Jirga system finalizes the conflict on spot but this further depends on the type of Jirga. In Sindh, Baluchistan and Interior Punjab the Jirga is headed by the Wadera, Chaudhary etc. even if he has no vision and no experience. Such Jirga leads to poor decisions and cannot provide justice. The most efficient and worthy Jirga system is the one which is adopted in FATA especially South and North Waziristan Agencies.

Even if the punishment is correct, by saying payment to the 'aggrieved' party, are we saying it was a rape? Cause otherwise both parties are equally at fault. Clearly shows that this was just a means to fleece money. Won't be surprised that this practice becomes a 'business' where in men will be lured in and then be forced to pay the 'aggrieved'!!
