PESHAWAR, Feb 14: The Peshawar High Court on Monday dismissed the bail petitions of two persons accused of seizing an official vehicle and using it in terrorist activity, while granting bail to five other suspected militants in separate cases.A single bench comprising Justice Dost Muhammad Khan observed that petitioners Maulana Siddiqullah and Ali Muhammad did not deserve to be extended the concession of bail.

The two petitioners were arrested a few months ago and charged in a case registered at Buner police station on April 13, 2009. The police alleged that they were part of a Tehrik-i-Taliban attack on a hospital in Nawagai area and taken away an official jeep.

Later, the police said, the jeep was found in damaged condition as it was used in a terrorist activity.

The state counsel argued that the petitioners were directly charged in the case and the evidence on record proved their involvement in the offence.

Meanwhile, another bench of the high court comprising Justice Mazhar Alam Miankhel granted bail to four suspected militants charged with attacking Mingora police station in Swat District.

The court directed the petitioners -- Muhammad Iqbal, Luqman, Momin Khan and Wahid Zaman -- to furnish two sureties of Rs500,000 each.

The prosecution has alleged that militants including the petitioners had attacked Mingora police station on May 7, 2009 with heavy weapons which had resulted in damage to the building and injuries to a policeman.

The lawyers appearing for the petitioners contended that they were not directly charged in the FIR and were arrested only on basis of suspicion. They argued that merely on basis of hearsay the petitioners could not be kept behind the bars. They added that no eyewitness testified against the petitioners.

Similarly, another bench comprising Chief Justice Ejaz Afzal Khan granted bail to a suspected militant charged with planning an attack on Khwazakhela police station in Swat.

The petitioner, Aizazullah, was named by some suspected militants during investigation after they were arrested.

In the FIR of the case registered at Khwazakhela police station on Nov 6, 2007, the police alleged that they had received information that militants would attack the station. It was alleged that some of the suspects were arrested when they were going to attack the station.

Advocate Nasir Naeem appeared for the petitioner and contended that the prime suspects arrested in the case had already been set free on bail. He added that there was no evidence on record to connect the petitioner with the said conspiracy.
