HYDERABAD, May 24: A division bench of the Sindh High Court Hyderabad circuit, on Wednesday, issued notices to District Nazim, DCO and Taluka city Nazim Hyderabad for May 29 on public interest litigation seeking removal of a makeshift market of used motorcycles on main road in Khokhar Mohallah, was causing nuisance to public, especially patients.

Furniture and fixtures dealer, Amiruddin Munshi submitted an application which had been converted into a petition by the court. He said the business of used motorcycles was running in an unregulated manner which posed problems for residents.

He said the market creates problem in the movement of residents as a large number of dealers and purchasers throng the area after 7pm and remain up to one in the morning. "Residents had confined themselves inside their homes due to the outside rush and for any work they force their way with great difficulty", said the applicant.

He said on complain of residents, dealers turn violent and continue their activities as usual. Another problems was the high pitch in which they communicate with their customers. They don’t hesitate in using abusive language which was a psychological nightmare for the residents as children pick such habits, he said.

"Patients, especially terminally ill, suffer more from this situation and their shifting to hospital becomes a gigantic task due to congestion. And so do women, who can hardly go out or enter into their homes", he said.

The applicant also hinted at the element of criminal activity involved in the situation as stolen and snatched bikes too, were being traded in market and damage to life or property of any resident couldn't be ruled out. He pleaded that to get rid of this situation residents had filed applications before District Nazim, Taluka Nazim, District and Sessions Judge and Regional Police Officer (RPO) Hyderabad but without any results.

He prayed the court to restrict shopkeepers to perform their activities within premises and Taluka Municipal Administration (TMA) and to remove movable and immovable property that fell in the category of encroachment.

He requested the court to direct police in getting the market closed by 8pm. He pleaded the court to direct district administration to make arrangements of shifting such markets outside the city and maintain a liaison with the concerned police to prevent holding of such markets in the said area.
