HYDERABAD, Oct 25: The DSP, CID unit, Hyderabad, on Monday informed the Sindh High Court, Hyderabad circuit, that the officer who investigated the caseof abduction of 14-year-old girl Nayab had spoiled the case.

The DSP, Hyder Bux Khoso, added that the girl could not be recovered due to influence of one Makhdoom Fazal Hussain, who, according to statements of prosecution witnesses, was involved in the case. However, he said except for statements of the witnesses, no evidence could be found against Mr Hussain, a local People's Party Parliamentarians leader, to place his name in the supplementary charge-sheet of the case.

The DSP submitted his report before the court which adjourned the matter as the counsel for Mr Hussain sought time to file rejoinder.

He said the witnesses had pointed fingers on Mr Hussain, alleging that he was a supporter of the accused. He said he had submitted a report, incorporating the witnesses' claim about holding of a jirga by Mr Husaain which was attended by the complainant and the accused.

He said former investigating officer SI Hussain Bux Nizamani had arrested Acchar, Noor Mohammad, Shama and Mai Pathani. He added that on Dec 31, 2003, Shama and Pathani were released by the officer under section 497 of Cr.PC.

He said the investigating officer, however, had not arrested accused Sanna, Mushtaq Ali Arbab, Master Amir Bux Arbab, Zulfiqar Arbab and Naheed. He said the officer had only recorded their statements and he had not bound them to appear again for investigation which indicated his negligence.

The DSP said the investigating officer had not sought permission from the SP, investigations, for releasing Achar and Noor Mohammad under section 497 Cr.PC.

He alleged that Mr Nizamani had supported the accused during investigation and released four of them while the remaining six had never been arrested.

The DSP said under directives of the high court, he had recorded statement of the investigating officer who had claimed that the girl had not been kidnapped but she herself had left her house.

He prayed the court to order departmental and legal action against SI Nizamani.

The girl's father, Abdul Rasheed Memon, had sent an application to the Chief Justice of the Sindh High Court and then the case had been referred to the SHC's Hyderabad circuit which had converted it into a petition.
