PESHAWAR, Oct 20: A two-judge bench of the Peshawar High Court on Wednesday summoned the principal of the Saidu Medical College in a contempt of court case.

The bench comprising Chief Justice Nasirul Mulk and Justice Qaim Jan Khan ordered that the principal, Azizur Rehman, should appear on Oct 27.

The principal has not obeyed a high court order regarding admission of the petitioner, Sohail Ahmad.

Advocate Gohar Rehman Khattak, appearing for the petitioner, stated that an appeal filed against the high court judgment had been dismissed by the Supreme Court but the principal was reluctant to follow the order.

The chairman of the medical colleges' joint admission committee, Dr Khalid Mufti, who appeared on court notice, said he had issued orders for admission of the petitioner to the Saidu Medical College but the principal did not follow his directives.

Mr Khattak informed the court that the NWFP advocate-general had contacted the principal and tried to convince him to follow the order, but the principal had refused to accept his advice.

The petitioner had applied for admission but the admission committee had rejected his application on the ground that he possessed two domiciles, one of Mardan district and one of Mohmand Agency.

He filed a writ petition before the high court, which was accepted and the PHC ordered that his domicile of the tribal agency should be considered and the other one should be cancelled.

The court observed that tribesmen residing in settled areas normally possessed double domiciles.

When the petitioner was not given admission, he filed a contempt of court petition. On Sept 2, Dr Mufti informed the court that he had issued orders for providing admission to the petitioner and he should go to Saidu Medical College. However, when he visited the college, the principal refused to give him admission.
