HYDERABAD, April 5: The third senior civil judge of Hyderabad, Allah Jurio Parhiar, has dismissed a case filed by a coach service about cancellation of permit to operate service by the Provincial Transport Authority (PTA) after hearing the version of defendant Raja Sikandar Hayat, a Belgian national of Pakistani-origin.

The plaintiff filed the suit through managing partner, Saghir Ahmed, against Raja Sikandar Hayat, Mohammad Ramzan Palari, the District Regional Transport Authority, Hyderabad, the DPO of Hyderabad, the DSP of traffic police and the secretary of transport.

The plaintiff argued that he had been granted permission to ply new buses on the Hyderabad-Karachi route and about one week back defendants Raja Sikandar and Mohammad Ramzan Palari threatened his employees at the Mehran bus terminal, Baldia Bus Stand, saying they would not allow them to run the service.

He sought permission to ply buses as per permission granted by the District Regional Transport Authority.

The defendant, Raja Sikandar Hayat in counter-affidavit said that the permission had been obtained by plaintiff through fraud which had been cancelled by secretary PTA through an order dated January 25.

He said that plaintiff was not entitled to ply bus service on said route from any place as it was authorised to defendant. He had also filed contempt of court application against contemnor, additional DPO Pervez Chandio seeking action against him for disobeying court’s order of March 26 in suit, directing parties to maintain status quo.

He said that court had ordered the parties to maintain status quo which was violated by plaintiff and contemnor. He added that he moved an application before contemnor on March 11 for action for violation of status quo.

He said on March 18 he moved application to contemnor and appeared before him in person. Both parties were summoned to the office of the TPO of Qasimabad, he said.
