Panamagate hearing: second letter from Qatari royal 'clarifies' Sharif investment in Gulf Steel Mills

As the Panamagate hearing resumed Thursday, a second letter signed by Qatari royal Hamad Bin Jassim Bin Jaber Al-Thani submitted to the Supreme Court attempted to offer up clarification on the Sharif family's business ties and money trail in the Middle East.

The letter attempts to shed light on "certain queries... raised with respect to my statement dated Nov 5, 2016."

The second letter from the Qatari royal, like the first which was submitted in court last November, is marked private, confidential and not to be disclosed to any party, except for the benefit of the courts of Pakistan, and on the letterhead of Hamad Bin Jassim Bin Jaber Al Thani, who ruled Qatar from 2007 to 2013.

In it, Al-Thani says PM Nawaz's father, Mian Muhammad Sharif, made an investment of approximately 12 million dirhams in the Al-Thani family's real estate business.

"The investment was made by way of provision of cash which was common practice in the Gulf region at the time of the investment. It was also, given the longstanding relationship between my father and Mr Sharif, a customary way for them to do business between themselves," it said.

"At the end of 2005, after receiving all accruals and other distributions made over the term of the investment, it was agreed that an amount of approx $8,000,000 was due to Mr Sharif. The amount due to him was settled in 2006," the letter explained, "by way of the delivery to Mr Hussain Nawaz Sharif's representative of bearer shares of Nescoll Ltd and Nielsen Enterprises Ltd, which had been kept during that time in Qatar."

The letter is accompanied by transaction details and auditor's reports regarding the Gulf Steel Mills in Dubai and the Azizia Steel Mills in Jeddah.

Other documents submitted in court today by Hassan and Hussain Nawaz's counsel include a land acquisition deed for the Gulf Steel Mills in Dubai and a letter verifying the existence of the mills, as well as other documents pertaining to the sale of the Gulf and Azizia mills.

A confirmation letter signed by the director general of a municipality said the mills used to exist in Dubai in the mid 1970's on a rented plot of 1,000,000 square feet.

Regarding the Sharif family's Park Lane flats in London, the reply said they were bought by Mian Muhammad Sharif for his grandsons. During the family's years in exile, Hussain and Hassan Nawaz were living in the London flats, it said.

Maryam Nawaz's BMW

Resuming his arguments before the apex court, Maryam Nawaz's lawyer Advocate Shahid Hamid told the court he would submit tax returns regarding gifts given to the prime minister from his children.

The subject of discussion turned towards a car Maryam Nawaz was allegedly gifted by her brother Hassan.

"How was so much profit earned through the sale of the BMW?" Justice Ejaz Afzal wondered.

Hamid told the court the BMW was bought by Hassan Nawaz in 2006 and gifted to Maryam Nawaz two years later.

"In 2011, Maryam Nawaz sold the BMW for Rs2 million," Hamid said.

'PM Nawaz did not make misstatements in NA speech'

Prime Minister Nawaz Sharif submitted a reply in court responding to arguments made by Jamaat-i-Islami (JI) lawyer Advocate Taufiq Asif before the apex court during a hearing of the case earlier this week.

"The prime minister did not make any misstatements in his speech in the assembly," the reply said, referring to the speech made by the premier on the floor of the National Assembly last May, following the Panama leaks.

The reply maintained that Nawaz Sharif does not own the London flats. "The prime minister is not the beneficial owner of any of the four flats."

Where there are big question marks over integrity of leaders and they require foreign intervention to prove their credibility than there is big question mark that these leaders can credibly lead the country.

These letters are just complicating the matter further. His Royal Highness needs to visit the Supreme Court and clarify his stance in person.

Also the media can play a good role here, by going to Qatar and asking the prince for an interview to clarify his position. I'm surprised they haven't done this already.

I still believe a letter does not clarify as a money trail. If the Prince is so honest, they must produce a document with all the banking transactions showing how and when the money got transfered. I dont think SC can take a word for the prince for this.

This is insane. The SC should not take these letters as credible evidence, unless and until theyou summon the Prince in person and thoroughly cross-examine him. They should also take into consideration the corruption this Prince himself has committed whilst holding office for his own government.

In financial cases the asset valuation and transaction trail is the key worldwide. Furthermore, if this letter is accepted then there will be countless parties in Pakistan who will ask their 'FRIENDS' abroad to draw up letters and send to the respected courts. In fact this matter should be considered as undermining the courts and obstructing justice - courts must issue notice to the Qatari Govt. The facts of the case must be declared before the case was filed and not as it suits the defendants or petitioner.

Another made up Qatari letter contradictory to reality.Qatar entire wealth is dependent on oil wealth,transactions of which is entirely carried out through banking channels.After British left in 1971, local banking sector also flourished due to oil boom of 1973.So it is entirely wrong that investments in 1980's were carried out in cash,in fact it is was the other way round.

@SR First of all the word you are looking for is sanctions. Kindly state what sort of sanctions would they be? will they stop military aid to us? and the Qatari letter also stated that YOU have to be sent to Qatar as part of a low paying bonded labor scheme. But like you so eloquently and judiciously stated, the Pakistan gov't has to do what the letter says, no other options. Enjoy, I hear Qatar is great this time of year.

It had very little to do with 9-11 it was the fact that Pakistan was not really affected by the sanctions. The underground economy is so big and vibrant that it actually did quite well.

As you may recall real estate prices rose consistently in the 1990's.

The deal with Qatar will not affect Pakistan it will only affect Nawaz league and Qataris. We are a large country and can absorb a lot as you can see..the poor continue to eek out a living even though the leaders give them nothing.

P.S Pakistan is the 5th largest grain producer in the world.

Once for all - SC should ask NS and family to declare ALL their international accounts, money (cash or otherwise) given to a prince and other assets UNDER OATH. every time there is a question a new story and asset comes up.

Can a letter from a private individual be accepted as a legal document in a court of law?what the law say about it?And instead of producing letters why not presenting the receipts,bank transactions and the transfer deeds?Moreover if,as reported,the flats were transferred to Husain Nawaz in consideration of the shares of Mian Sharif in the joint business,is there any mention of this in the sale purchase deed,according to which his shares in the offshore companies were transferred to Husain nawaz but not against cash receipts.If the sale deed shows the deal was done against cash then the letter is definitely a cooked one.

Just imagine, if situation was reverse , a letter from Nawaz Sharif in the support of a Qatari citizen charged with corruption, the letter would right away end up in a trash basket. Here our court is allowing this letter as evidence. Why does n't court ask Qatari prince to appear in the court as a witness ? Easy said than done, who will bell the cat !

For God sake, Qatari prince, please send the ownership document of the London flats or the ownership documents of the corporations that owns these flats. If you registered these corporation in Panama, you should have registration documents. Pakistan wants to resolve this case as soon as possible.

This is blatant attempt to influence an ongoing legal proceedings in Pakistan and interference in Pakistan's internal affairs. The SC never summoned or requested anything from the Qataris. If any one had direct information or documents to corroborate the Sharif family's stories, it should be the UAE or Saudi governments, where the alleged steel mills were founded and sold eventually.

Furthermore all the cash transactions, quoted in Riyals and Dirhams, later converted to nice round $ numbers, smacks of a money-laundering scheme to dilute the true intent, ownership, source of funds, and distribution as well as transfers between parties. It all sounds very very fishy!!!
