Ex-CJ’s son challenges PTI return to parliament

LAHORE: The Lahore High Court on Wednesday issued notices to federal and Punjab governments on a petition challenging Pakistan Tehreek-i-Insaf’s return to parliament.
Arsalan Iftikhar, son of former chief justice Iftikhar Muhammad Chaudhry, filed the petition pleading that parliamentarians of the PTI had tendered their resignations to speakers of respective assemblies. He stated that speakers, however, did not accept the resignations.

Whereas, constitutionally the parliamentarians of PTI were no more members of assemblies once they tendered the resignations, he added.
The petitioner said attending the assemblies’ sessions by PTI’s former parliamentarians was an unconstitutional act.
He asked the court to direct the Election Commission of Pakistan to de-notify all PTI’s parliamentarians who had tendered their resignations.
The court adjourned the hearing till April 22 and sought replies from the Centre and the Punjab government.

It is the Government who has persuaded PTI to rejoin the National Assembly. Why did the Speaker National Assembly not accept resignations of PTI law makers? PTI is not at fault.

What I fail to understand is why an ex Chief Justice and his son are always making headlines about politics. Probably what Mr. Musharaf did to the CJ was right, the guy has veritably politicized the apex court of the country.

He has nothing to do with politics, but just to show that he is a nice person, he must speak against political parties. This is a old trick and now it does not work.

since long time masses are suffering millions of problems. Now time has changed, world has changed, kids are learning themselves form E sources. This would be nice to launch a new E campaign to expel RENT A CAR (RAC) type leaders for politics. Rental leaders are asking financial help from rich businessmen and later they use them as a RAC item to achieve the objectives. RAC leaders are available in different part of world, East to West & +.

The petition makes sense. PTI MPAs and MNA's who resigned in 2014 at their free will, should be de-notified by the ECP and should not be allowed to attend the sessions of the parliament. Re-election needs to be held on the vacated seats.

If...if its that very unconstitutional act then why not file a complaint against the speaker saheb ? and ask for his removal from the seat for allowing unauthorised persons to attend the session. CJ's son is also requested to note that it is not a normal session but called to discuss the Saudis demand for our participation in their naked aggression against Yemen and PTI is against it...so let them attend this session...please.

Good move as Imran still rattling this assembly fraud. If Imran apologises over his nasty comments then he should not be disturbed. But if he keeps saying fraud assembly, fraud assembly then to unseat in justified. By the way I wonder how PTI feel easy in assembly.

All corrupt people stand to lose if PTI is in the assemblies. They are not happy when PTI is on streets, and still not when they are back in the house for which they were rightfully elected.

@Har Har ......Mr Har Har what constitution, is there anything in Pakistan that goes according to constitution. Lets start with justice first, the single most problematic issue. Give justice to every citizen , that is constitution; to do that lets pick the right leaders. If there is no opposition then there is no functioning government....Lets pick the right leader first and foremost, lets give Imran Khan a chance because we have tried most of them already.

As an attorney, who practiced in Pakistan and now in USA, it is despicable that higher courts have this much time on such frivolous motion. Simple question always asked in all such proceedings? Does he has any standing? Is he stepping into the shoes of someone whose has standing? Has any of his personal rights have been violated? If the answer is no, the proceedings cannot go any farther.

so the govt. wants PTI to join. Arsalan along with MQM believes it is a violation of constitution and that is a fact, it is a violation. But then the case should be filed against the speaker of the parliament who did not accept the resignation due to what ever the reason may be. PTI tendered their resignations. If speaker did not accept it, that is not a PTI issue. He need face his cannons to the correct party. Seems like he is holding a personal grudge against PTI.

Assembly is all about politics. This is a main goal of IK to become PM. Isn't? If not why does PTI take part in election? This is politics should be run with law and order.

Arsalan Iftikhar Chaudhry had allegedly promised to influence his father's rulings.
Arsalan Iftikhar Chaudhry, son of Chief Justice Iftikhar Muhammad Chaudhry, resigned on 3 July 2014 from his post as Vice Chairman of Balochistan Board of Investment. The appointment was being criticized heavily by the media and opposition parties. His appointment was also being linked to the alleged role of the former Chief Justice of Pakistan, Iftikhar Muhammad Chaudhry, in the alleged rigging of General Elections 2013
