KARACHI, Dec 18: An anti-narcotics court acquitted on Tuesday five men in a trafficking case and ordered legal action against two police officers.

Fida Muhammad, Mansoor, Nek Mohammad, Ahmeduddin and Kifayatullah were charged with carrying a total seven and a half kilograms of hashish within the remit of the Rizvia Society police station in Sept 2009.

Judge Sanaullah Ghory of the Special Court-II for Control of Narcotic Substance exonerated the accused for want of evidence.

The court also ordered legal action and a departmental inquiry against investigation officer Inspector Sarfraz Khawaja and complainant Sub-Inspector Ejaz Ahmed Memon directing the police high-ups to submit a compliance report in court.

The court in its verdict ruled that the alleged recovered drugs were not properly produced in court as according to the memo of recovery hashish was found in the shape of rods while the produced drugs were otherwise.

The police also said to have found currency notes in the possession of the accused, but it was highly surprising that the notes produced in court were printed in 2011 while the recovery was shown in 2009, it added.

The court observed that it was gross negligence on the part of the complainant and the IO.

The police had booked the accused under Sections 6/9-B & C of the Control of Narcotic Substances Act, 1997.

Meanwhile, the same court on Tuesday also ordered a probe against three police officers into disappearance of the case property in a narcotics case.

The CID police claimed to have arrested Mohammad Amir in 2011 and found 80 kilos of hashish in his custody.

However, during his evidence, a prosecution witness deposed that the hashish produced in court was not the contraband that had been recovered from the possession of accused.
