PESHAWAR, Oct 25: A Peshawar High Court bench on Tuesday directed the federal government to produce the names of field commanders of security forces, who served in Swat from June to December 2010, on November 15 for hearing into the alleged forced disappearance of an employee of the University of Peshawar's Khyber Law College.

It also expressed annoyance over the government's failure to submit details of the internment centres set up in the province and those detained there, despite deputy attorney general Iqbal Mohmand's assurance two months ago.

The bench consisting of Justice Dost Muhammad Khan and Justice Yahya Afridi was hearing a habeas corpus petition challenging the alleged illegal detention of a junior clerk of Khyber Law College, Adil Shah.

The clerk's wife, Sabeeha, had filed the petition, alleging that a team headed by a Pakistan Army major had taken her husband into custody on July 11, 2010 before handing him over to Colonel Hassan Khattak of 18 FF regiment stationed in Swat.The detainee's father, Pir Sadiq Shah, appeared before the court and claimed that the said colonel arranged his meeting with his son along with his wife last year on the fourth floor of a Swat hotel that was turned into detention centre.

On the last hearing, the court had directed the administration of Malakand Division to approach the relevant military officers in Swat to know the whereabouts of the clerk. An official of the Swat district administration, Attaullah Khan, showed up on behalf of DCO and said he had visited the said detention centre but didn't find the clerk there.

Meanwhile, another bench of the high court comprising Chief Justice Ejaz Afzal Khan and Justice Waqar Ahmad Seth summoned deputy superintendent of police, Peshawar Shahnawaz Khan to appear before it on Wednesday (October 26) and clarify his position regarding the alleged detention of a citizen.

Salahuddin Khan of Peshawar had claimed that a police team headed by SHO Gulberg police station Zahid Ali and DSP Elite Force Shahnawaz Khan took his relatives Zarwali and Zubair Khan into custody around 11 months ago and freed the latter only after a month. Tafseel Afridi, lawyer of the petitioner, said the released relative later furnished an affidavit about the detention.

Meanwhile, another bench comprising Justice Shahjehan Khan Yousufzai and Justice Miftauddin Khan disposed of a habeas corpus petition due to the return of the alleged missing person, Hazrat Ali.
