PESHAWAR, Nov 6: A two-member bench of Peshawar High Court on Wednesday upheld the death penalty awarded to a convict for killing a former inspector-general of police, Mohammad Yousaf Orakzai.

The bench, comprising Justice Nasirul Mulk and Justice Ijazul Hassan, dismissed the appeal filed by the convict, Mussarat Khan, and observed that the prosecution had proved its case against him.

Mr Orakzai was killed on Oct 11, 1999, near Abdara Chowk. The appellant was arrested on the spot.

The motive behind the murder was a decades old land dispute between the Orakzai tribesmen and inhabitants of Regi.

A trial court presided over by Additional District and Sessions Judge Azeem Afridi had convicted the appellant on July 15, 2000.

Barrister Zahoorul Haq appeared for the complainant, Abdul Fayyaz represented the state and  Khwaja Mohammad Khan of Gara appeared for the appellant.
