ISLAMABAD, Feb 21: Federal Tax Ombudsman Justice Saleem Akhtar has recommended to the Central Board of Revenue to advise the taxation officials to carry out income tax assessment in accordance with the income tax law and procedures.

The decision was taken on the complaint of Mehrban Traders, D.I. Khan. They complained that tax officials were carrying out assessment of income tax of the company in violation of tax law and procedures.

The Ombudsman recommended to the CBR to cancel the income tax assessment for the assessment year 2002-03 in the complainant's case and a fresh assessment be made after allowing due opportunity of being heard to the complainant.

He further said that the fresh assessment be made by an officer other than the officer, who made the original assessment. He said that a warning letter be issued to the income tax official, Fayyaz Khan, for his maladministration.

The justice further said that the conduct of the income tax officials in the context of his dealings as a customer with the complainant might also be examined by the relevant authorities.
