ISLAMABAD, Jan 22: The Supreme Court on Thursday upheld the Peshawar High Court judgment in which it had declared the Nazim of Union Council Shahpur, Kohat , disqualified for not being a matriculate and had ordered a re-election.

The Supreme Court bench, comprising Chief Justice Nazim Hussain Siddiqui, Justice Javed Iqbal and Justice Abdul Hameed Dogar, dismissed the appeal filed by Sarli Gul and upheld the Peshawar High Court verdict.

Sarli Gul, a retired subedar, was unseated by the Election Tribunal for not possessing the required educational qualification, and had declared the runner-up, Fayyaz Khan, as the chairman of Shahpur Union Council.

The Peshawar High Court, however, modified the decision of the tribanl to the extent that Sarli Gul had been rightly unseated but wrongly declared Fayyaz Khan as the Nazim of Shahpur, and ordered a re-election to the seat.

The Supreme Court, after hearing Syed Iftikhar Hussain Gillani, counsel for Sarli Khan, and Attorney-General Makhdoom Ali Khan, who was on court notice, dismissed the appeal and upheld the Peshawar High Court decision, ordering re-election to the seat.
