KARACHI, May 14: A division bench of the Sindh High Court comprising Justice Azizullah M. Memon and Justice Khalid Ali Z. Kazi on Wednesday summoned the capital city police officer on grievances expressed by the Karachi Building Control Authority’s counsel for not assisting the city government police station set up to assist the KBCA and CDGK in dealing with violators of KBCA rules.

The division bench was hearing a petition filed by residents of Nasim Plaza in Garden West. The structure was marked as a ‘dangerous building for human life’ by surveyors of the Karachi Electricity Supply Company.

The residents moved the SHC against the builder of the project, Mohammad Ashfaq, for violating the approved plan by constructing shops in the necessary open space and renting out the basement – reserved for parking – to a garment factory. They also made the KESC respondent for using substandard wires for electrification.

Petitioner’s counsel Shakeel Ahmed stated that the said structure was declared dangerous by the KESC, but it took no measures to rectify the problem.

Jamiluddin Ahmed, KBCA counsel, stated non-cooperation of the police and sought directions for the police to assist the KBCA in demolition and assured that legal action would be taken against violators of the law.

The bench expressed annoyance over the ignorance of the police officials of their legal obligations and said “any loss occurred to anybody shall be borne to KESC.” It summoned the CCPO Karachi on the next date of hearing and adjourned the matter to a date in office.

Notices issued

A division bench of the Sindh High Court on Wednesday issued notices to the KBCA, Oil & Gas Regulatory Authority (Ogra), CDGK and others for May 20, 2008, on a petition filed against the suspension of a no objection certificate (NOC) of a CNG station and sealing the construction of the said station in a residential area by the ombudsman of Sindh.

Petitioners Mohammad Tahir Qureshi and his three partners moved the SHC against the order of the provincial ombudsman, Sindh, wherein he sealed the construction of a CNG filling station and suspended the NOC of the KBCA, issued in favour of the petitioner to convert residential plot No 591, situated in Gujarat Cooperative Housing Society, Jamshed Town, into a commercial property.The orders of sealing construction and suspending the NOC came after complaints of area residents, who alleged that the petitioner violated Ogra rules.

Meanwhile, notices were also issued to the interior ministry, DG Rangers, executive district officer (revenue), survey superintendent Sindh and others for May 25, 2008, on a petition filed against encroaching 79.2 acres of land by the Rangers.

The petitioner – Collachi Cooperative Housing Society – approached the SHC against the alleged encroachment of land at Deh Okewari, Tapo Songal, Karachi East by the Rangers by submitting that the said land was allotted to the petitioner by the Land Utilization Department and EDO (revenue) under Section 10(1) of the Colonization of Lands Sindh Act. It was leased to the petitioner but personnel of the Rangers are attempting to set up camps and started raising constructions illegally on the said land.

The division bench restrained the respondents from taking any action adverse to the rights of the petitioner till the next hearing.—PPI
