KARACHI, April 25: The additional district and sessions judge, Malir, Aftab Ahmed, on Friday granted bail to the chief of the Mohajir Qaumi Movement (Haqiqi), Afaq Ahmed, in a murder case against a surety bond of Rs200,000.

According to the prosecution, Zubair Ali, son of Mashooq Ali, along with his mother, Rafiqun Nisa, on July 30, 2002 was on his way home in Nazimabad in a cab, when they heard gunshots. He directed the cab driver to change the route and decided to go to his sister’s house. When the cab reached Ammar Yasir Society near Lilly Town, three to four unknown persons allegedly opened fire on their taxi, injuring his mother and the taxi driver, Kafiluddin.

The complainant took his mother to Al-Mustafa Trust, while Kafiluddin was taken to the Jinnah Postgraduate Medical Center where he died from bullet wounds.

The police had registered a case (FIR No144/02) under Sections 302, 324, 109/34 of the Pakistan Penal Code at Malir City police station against the chief of the Mohajir Qaumi Movement (Haqiqi) and others, stating the firing had taken place at the behest of Afaq Ahmed.

According to Advocate Suhail Anjum, the MQM-H leader has been tried in 12 cases, five of them pertaining to murders. Now, he said, only four cases were being tried. Two of the cases, registered by the police at the Landhi police station under Section 13-E of the Pakistan Arms Ordinance and Explosives Act, were being tried in the court of the additional district and sessions judge-VI, East, who had rejected a bail application on April 24.

The third case pertained to the kidnap and murder of four persons in the limits of the Landhi police station on June 19, 1992. A case (FIR 102/92) was registered under Sections 147, 148, 324, 302, 364 and 365-A of the Pakistan Penal Code. The case was being tried in the court of an additional district and sessions judge, East.

The fourth case pertained to the murder of a taxi driver, in which the court on Friday granted him bail.

Suspects remanded

The civil judge and judicial magistrate, East, Allah Bachayo, remanded two more suspects in police custody till April 28 for their alleged involvement in the gang-rape of an 18-year-old woman on the premises of the Mazar-i-Quaid.

The police on Thursday arrested an accountant and a personal assistant to the resident engineer of the Quaid-i-Azam Management Board following the receipt of the DNA report confirming their involvement in the case.

An official of the mausoleum’s security, arrested on March 20 for his alleged involvement in the case, was already in jail.

According to the prosecution, an 18-year-old woman was subjected to sexual assault after being kidnapped from the premises of the Mazar by unknown men on the night of March 15 and was found in an unstable condition outside the mausoleum on March 17.

The case (FIR No 50/08) was registered at the Brigade police station under the Section 365/B of the Pakistan Penal Code on the complaint of her father.

Bail plea rejected

The civil judge and judicial magistrate-X, South, rejected the bail application of Agha Javed Pathan.

According to the prosecution, he was booked on April 9 on charges of manhandling the former Sindh Chief Minister, Dr Arbab Ghulam Rahim, and possessing illegal weapons, hashish and a stolen motorcycle.

Four cases (FIR Nos. 199/08, 200/08, 201/08 and 202/08) were registered against him under Sections 392, 504, 427, 448, 147, 148, 337-A and 506-B of the Pakistan Penal Code, 13-D of the Arms Ordinance and Section 6/9-A of Control of Narcotic Substance Act at the Preedy police station.
