PESHAWAR, April 1: The Peshawar High Court on Tuesday put on notice the NWFP advocate general and the AIG of Crimes Investigation Department (CID) in a habeas corpus petition challenging alleged illegal detention of a person by the department for over three months.A two-member bench comprising Justice Said Maroof Khan and Justice Syed Mussadiq Hussain Gillani fixed April 3 for next hearing in the petition filed by Ms Sadiqa, mother of the alleged detainee Ikram Khan.

The petitioner claimed that her, who is about 21, was a driver of a passenger coach plying between Peshawar and Mohmand Agency. She claimed that they belonged to Mohmand Agency and her husband, Yar Khan, was in Saudi Arabia in connection with earning a livelihood.

The lady claimed that on Dec 22, 2007, he was on his way to Peshawar when he was stopped by the law enforcing agencies near Adezai. She added that her son had been missing since then. She claimed that she continued to search for him and a few days ago she came to know that he had been detained at the centre of CID on the University Road.

Advocate Asthagfirullah Khan appeared for the petitioner and contended that the detainee had not been produced before any court till date. He added that the continuous detention of the young man was illegal and unconstitutional.

Mr Khan stated that the detainee was neither charged in any case nor he was accused of committing any offence in the past.

The respondents in the petition are: the NWFP provincial police officer, the Peshawar city police chief, the AIGs of CID and Crimes Branch Police and the provincial home secretary.
