KARACHI, Jan 25: A Sindh High Court division bench comprising Justice Rahmat Hussain Jafferi and Justice Munib Ahmed Khan on Thursday dismissed the bail application of Alam Sher, a Pakistani, and appeals moved by two Nigerians against their conviction by an anti-narcotics court.
Special prosecutor Syed Ashfaq Husain Rizvi argued that Sher Alam was found in possession 1.1-kg of heroin and his case was hit by Section 9 of the Anti-narcotics Law, which barred grant of bail to an accused found in possession of over one kilogramme of narcotic substances. The Nigerian convicts, Okozaje and Michael, have been sentenced to a four-year imprisonment and a fine of Rs50,000 each. The prosecutor said the trial court had already taken a lenient view and handed them down lesser punishment.
FIR REGISTRATION: Justice Amir Hani Muslim asked the police to record the complaint of Faisal Butt, an outdoor advertiser, and register an FIR against the divisional superintendent of railways and his subordinates responsible for the dismantling of his billboard, installed near the railway station on Chundrigar Road, in violation of a court order if an offence was made out against them.
PRESIDENTIAL POLL: Maulvi Iqbal Haider of Awami Himayat Tehrik has filed a petition for a declaration that the present assemblies were competent to re-elect President Pervez Musharraf. The petitioner also says that since the parliament and the provincial assemblies voted for the president on December 31, 2003, the five-year tenure would expire on December 31, 2008. The petition is fixed for hearing before a division bench.
