IHC rejects Hubco’s petition against FBR notice

ISLAMABAD: The Islamabad High Court has dismissed a petition filed by the Hub Power Company challenging a show-cause notice issued by the Federal Board of Revenue (FBR), reinforcing the tax authority’s jurisdiction in the matter.

According to court documents, the petitioner company questioned the legality of the notice issued by tax authorities, arguing that the proceedings initiated against it were without lawful authority and contrary to the applicable tax framework. The petition also raised objections to the manner in which the tax demand was pursued, seeking judicial intervention to set aside the notice.

However, after examining the record and hearing arguments, the high court declined to interfere, effectively allowing the FBR to proceed in accordance with the law. The court observed that the impugned notice did not warrant constitutional intervention at this stage and that the petitioner could avail itself of alternative remedies available under tax laws.

The ruling comes against the backdrop of a broader judicial trend in which the IHC has shown restraint in tax matters, particularly where statutory remedies exist within the framework of the Income Tax Ordinance, 2001.
