HYDERABAD, April 17: Justice Munib Ahmed Khan of the Sindh High Court, Hyderabad circuit bench, on Monday issued bailable warrants against Abdul Rehman Mari, a landlord of the Sanghar district, and three others, in the case of kidnapping of family members of Manu Bheel.

The warrants were issued for their non-appearance in the court during hearing of an application for cancellation of bail.

The additional advocate-general, Sindh, Mr Masood A. Noorani cited Abdul Rehman Mari, Chaudhry Bashir, Hashim and Natho Bheel as respondents in the application for cancellation of their pre-arrest bail in FIR no 35/98 under sections 365 and 34 PPC, lodged by Shirmati Dharmi at the Jhuddo police on May 11, 1998, giving full account of kidnapping by the accused.

The AAG Sindh referred to re-investigation of the case and dismissal of cancellation of bail application by the sessions judge without giving any weight to a fresh piece of strong evidence.

He quoted important contents of the statement of Natho Bheel with particular reference to Abdul Rehman Mari, who had threatened him with serious consequence if he did not withdraw his confessional statement.

He said that the case was disposed of on October 13, 2002 as B-class on recommendation of then SSP Mirpurkhas but DPO re-investigated the case following permission from the DPO Sanghar only to suggest its disposal as B-class but the RPO Hyderabad disagreed and asked him to re-investigate it for which accused did not cooperate, affecting investigation process.

The AAG said that as far as alleged abduction of Manu Bheel’s family was concerned all roads of investigation lead to principal accused, Abdul Rehman Mari, whose interrogation was of crucial importance for recovery of detained persons.

He said that concession of bail being enjoyed by him was liable to be withdrawn in the light of evidence of Natho Bheel’s statement.

He said that Mr Mari had never joined or surrendered to police interrogation as besides the present kidnapping case there were several other cases and he was habitual of such offences whose details were mentioned in present plea.

He stated that sessions judge Mirpurkhas dismissed cancellation application on February 27 as he did not mention confessional statement of Natho Bheel wherein burden of production of detained people was placed on Mari’s shoulders while the judge also ignored the fact that Mr Mari was issuing threats to co-accused for becoming approver.

He said that arrest and interrogation of Mr Mari was linked with early resolution of the case and efforts and search for recovery of detained persons bore no fruits so far.
