HYDERABAD, Nov 8: The Sindh High Court, Hyderabad circuit bench, on Tuesday issued notices to provincial education department, Executive District Officer (EDO) Mirpurkhas, District Officer Education (secondary and higher secondary, and District Officer (elementary) Mirpurkhas, on a constitutional petition filed by six employees, seeking their reinstatement.

The petitioners are Mohammad Aslam, Shahid Rizwan, Miss Rafat Jehan, Mohammad Ismail Shah, Mohammad Saffar and Mushtaq Ahmed.

According to the petition, first three were appointed as junior school teacher (JST) and the other three as primary school teachers, Sindhi Language Teacher (SLT) and oriental teacher respectively in scale BPs-7 to BPS-9 in 1998 by the Sindh Education Department but their services were terminated the same year.

They said that as a matter of fact the services of petitioners and many other teachers, appointed in 1998 were terminated on account of political victimisation due to change of government.

He said that present Sindh government took up the matter of such teachers who were sacked in November and December 1998 and decided to reinstate 876.

They belonged to Mirpurkhas, Hyderabad, Sanghar and Nawabshah districts.

Accordingly a letter dated February 9,2005 was issued by the Sindh education department through which 876 teachers were reinstated in service and directed respondent EDO to comply with order after completion of formalities.

They said that the EDO authorised District Officer Education to reinstate the teachers and other officials, appointed in 1998 in their service treating their appointments afresh.

Subsequently, the District Officer issued common order, reinstating 44 male and 21 female teachers in their service, who were sacked in 1998.

They maintained that the EDO constituted a committee comprising members regarding reinstatement of teachers of Mirpurkhas district.

The petitioners appeared before the committee and produced their original documents, showing their appointments and their termination from service but the respondent EDO adopted policy of pick and choose and petitioners were deprived of reinstatement.

They said they were kept on false hopes in spite of repeated attempts by them.

They said that they were eligible for reinstatement in service and that act of respondents was illegal, malafide, discriminatory and against Islamic concept of social justice.

They maintained that respondents did not consider case of petitioners at par although their case was based on sound footings.

They prayed the court to direct respondents to reinstate petitioners in their service in accordance with directives of Chief Minister of Sindh as they had completed all formalities according to law. They said that respondents should be directed to act in accordance with the law.

MURDER CASE: The Sakhi Pir police lodged a murder case against three people for the killing of a 50-year-old man, Arif Qureshi in the Kali Mori area on Tuesday night.
