KARACHI: Court notice to Nazim

KARACHI, Jan 22: The Karachi Nazim was put on notice on Tuesday for Jan 29 by a division bench of the Sindh High Court in a petition challenging his alleged verbal order for allowing conversion of a residential plot into a commercial plot.

The bench, comprising Justice Sabihuddin Ahmed and Justice Zia Pervez, passed the order when a constitutional petition filed by Maroof Khan and 28 other residents of Metroville III, Site, came up.

It was the case of the petitioners that the Karachi Building Control Authority allowed conversion of residential plots into commercial plots. Looms for weaving cloth had been established by the purchasers of these plot, causing great inconvenience to the residents. They moved the KBCA which sealed the said factories/looms operating in the purely residential area.

The same bench also summoned the Nazim of Khairpur and the Nazim of Union Council Kot Diji on the same date on a petition filed by Mohammed Akram and other farmers who challenged the levy of “Langhani” (local tax) on sale of vegetables, etc. brought to Kot Diji and Khairpur from peripheral areas.

CONTEMPT NOTICE: The Sindh High Court issued contempt of court notices to two officials of the Pakistan Navy Benevolent Association (PNBA) for Jan 24 for non-compliance with its order.

The court was hearing a contempt of court application filed by Shell Pakistan Limited in a suit against the PNBA.

The plaintiff, filing an application under section 94 of CPC read with order 39, Rule 2 (3) of CPC and section 151 of CPC, submitted that on 8-2-2001, a bench of the SHC had ordered the PNBA to remove the barricades and guards from the disputed place and allow the plaintiff to run the same (petrol pump).

The plaintiff maintained that the said order was challenged by the respondents/alleged contemnor before a division bench of the SHC.

If the contemnors will fail to appear in the court on Jan 24, the application will be heard and decided exparte.
