HYDERABAD, Oct 12: The Sindh High Court, Hyderabad circuit bench, on Tuesday ordered the Hyderabad DPO to take disciplinary action against the then SHO of Makki Shah police station for violating a lower court’s order to register an FIR against railway officials and submit its report within two months.

The court allowed the applicant, Aurangzeb Khan, to lodge an FIR with the Makki Shah police against the Hyderabad DPO operations, Railways DSP Sardar Jaffery, Railways Assistant Engineer Imtiaz Siddiqi, Inspector of Works Abdul Hameed and the SHO of the Makki Shah police station.

Advocate Aijaz Sheikh of the applicant challenged the order of the first additional district judge, dated February 1, 2005, directing him to file a direct complaint instead of lodging an FIR against the accused.

The applicant said that he had 100 acres of land in Nareja deh, Latifabad taluka, where shops were situated and boundary walls were raised.

He said that the railway authorities were illegally claiming it their property and were trying to demolish it.

Mr Khan said that the Railways DSP along with the assistant engineer and inspector arrived at his property when repair work was going on and tortured his labourers.

The applicant said that the building material and other articles were taken away by the respondents.

He said that they also took away one of his employees, Sharoo, on the gunpoint.

He said the SHO of the police station had asked him to vacate the land and shops rather than taking action against the officials.

Mr Khan said that the first additional judge had ordered the SHO of the Makki police station to register an FIR, but the SHO had only recorded his statement instead of registering an FIR.

The high court observed in its order that the SHO daringly violated the order of the first additional judge by not registering an FIR and allowed the applicant to appear before the SHO Makki Shah police to record his statement so that further action would be taken.
