KARACHI, Aug 30: The Sindh High Court, issuing notices to all the parties in a case relating to a heritage building on M A Jinnah Road, has directed that no damage be caused to the building till the next date of hearing on Oct 20.
The order was passed in a suit instituted by an NGO, Shehri, and other tenants of the Shikarpuri Market against Abdul Majeed, Nasreen Rafique, Iqbal Poonawala, the Sindh Culture Department, the City District Government Karachi and the Karachi Building Control Authority.
The building, located next to Merewether Tower, is protected under the Sindh Cultural Heritage Protection Act. The plaintiffs stated that the building, which is owned by the defendant (Abdul Majeed has been sealed by the KBCA except the shops which are in occupation of tenants, but the defendant is demolishing it illegally.
The plaintiffs apprehended that the defendant may raise a commercial plaza..
Judge S. Ali Aslam Jaffery, after hearing the plaintiff’s lawyers, Rizwana Ismail and Khursheed Jawed, stated that notices be issued and also restrained the defendant from causing damage to the property or demolishing the same.
NOTICES TO AG: The Sindh High Court on Tuesday issued notice to AG Sindh and others on a petition filed by two businessmen against their harassment, PPI adds.
Saleem Hashim and Ramzan Hashim alleged that Syed Nasir Hussain Shah implicated them in a false case with malice and personal grudge on instigation of Bashir Ahmed Jokhio, Sardar Ali Akbar Khorejo, Abdul Rahim and Nasarullah, who have business dispute with them.
The court was prayed to restrain the respondents from harassment. SHC’s division bench, comprising Justice Ghulam Rabbani and Justice Azizullah M Memon, after preliminary hearing of case issued notice to AG and other respondents and called their comments.
CONTEMPT CASE: The Sindh High Court issued notice to the managing director of PSO and its divisional manager for Sept 5 on a contempt application.
Plaintiff Mansoor Rafi submitted that the court disposed of the lawsuit against the PSO on its statement to the effect that plaintiff’s license of petrol pump in PECHS, will not be terminated except in due course of law and without appropriately hearing.
SHC’s single bench, comprising Justice Khliji Arif Hussain, after preliminary hearing of the case, issued notice to contemnors and also observed that the plaintiff had to satisfy court about the maintainability of the application after disposal of the suit on an undertaking given on behalf of the PSO.
