KARACHI, July 28: The district and sessions judge, Malir, Mohammad Sadiq Bhatti, reserved on Thursday order on the application for the release of former nazim of Orangi Town.

The judge fixed Friday for the pronouncement of the order on the application after hearing arguments from defence counsel Shahdat Awan and district attorney Shamsul Hasan.

The judge also examined the station diary of the New Sabzimandi police post where former nazim of Orangi Town was allegedly lodged illegally.

The application was filed by Shakir Alam for the recovery of his brother, ex-nazim Mohammad Shahid Alam alias Guddu Bihari.

The judge had deputed a judicial magistrate for the recovery of former nazim from the police kiosk on the application of Dr Shakir Alam. The magistrate did recover Guddu Bihari from the police post, however, the police declined to release him.

In his report to the judge, Judcial Magistrate Mohammed Ehsan Khan Durrani sought strict legal action against the SHO and other police officials posted at the police post for not releasing Guddu Bihari.

In his report, the magistrate submitted that he checked the record of the police post, but no entry regarding the detention of Guddu Bihari was available on the station diary. He also submitted that both SHO and the post in charge said the detainee was not involved in any crime.

The JM stated that in spite of his direction, SHO Jamil Bungash declined to release the detainee. Besides, he refused to give magistrate a copy of the station diary register.

Defence counsel Shahadat Awan submitted before the court that the report submitted by the magistrate adversely reflects the condemnable conduct of police and the police intentionally obstructed the judicial magistrate to discharge his functions.

He prayed the court to award exemplary punishment to “the delinquent police officials as it was necessary for rule of law and respect of judiciary”.
