PESHAWAR: A single bench of Peshawar High Court on Monday dismissed bail petition of a person accused of killing deputy registrar of Abdul Wali Khan University Mardan with whom he was serving as driver.

The bench comprising Justice Mussarat Hilali observed that the petitioner, Wajid Khan, did not deserve to be extended the concession of bail.

The deceased, Mohammad Tariq, who was also director finance of the university, had gone missing last year and later on his body was found dumped in Sheikh Maltoon Town, Mardan on Nov 24, 2015. Police arrested the petitioner with the help of the cellular phone record of the deceased official.

Complainant in the case was Ashfaq Afzal, brother of the deceased. Police claimed that the petitioner was driver of the deceased.

They alleged that the deceased had purchased a vehicle in the name of the petitioner and had also invested money in certain businesses in his name. They alleged that the petitioner had killed the deceased official out of greed.

Advocate Saleem Khan appeared for the complainant and argued that the petitioner had also confessed his guilt.

He said that the deceased was killed in a very brutal manner and the petitioner had fired five shots at him. He contended that the weapon used in the offence was also recovered from the petitioner.

He added that the shoes and blood stained clothes of the deceased were also recovered on the pinpointing of the petitioner. The petitioner’s counsel argued that he was falsely implicated in the case.

He contended that it was an unseen occurrence and there was no eyewitness to the occurrence.

REPLY SOUGHT: A bench comprising Justice Roohul Amin Khan and Justice Syed Afsar Shah sought reply from National Accountability Bureau (NAB) and federal interior division in a writ petition filed by former director general of Peshawar Development Authority (PDA), Qazi Laiq, challenging the placement of his name on exit control list since 2014.

The petitioner was arrested in March last year after his pre-arrest bail petition was dismissed by the high court in a case of alleged illegal allotment of a precious five-kanal plot to a person on lease of 33 years at nominal price without fulfilling the codal formalities. He was subsequently granted bail by the high court.

The petitioner’s counsel argued that he was a grade-19 officer and his name was placed in ECL on the request of NAB, Khyber Pakhtunkhwa. He stated that the petitioner had already been granted bail by the high court.

He contended that the petitioner had to go abroad along with his family to attend marriage ceremony of his relative.

He added that after attending the said marriage he would return in early April. He requested the court to issue directives to the interior division to remove his name from ECL and he might be permitted to go abroad.
