IHC orders reinvestigation of Musharraf treason case

ISLAMABAD: Islamabad High Court (IHC) on Tuesday ordered reinvestigation of the Musharraf treason case and nullified the special court's earlier decision which had directed the federal government to resubmit its complaint in the case after including the names of abettors in the charge sheet.

The decision was announced in response to three petitions filed separately by Shaukat Aziz, Zahid Hamid and Abdul Hameed Dogar against the order of the special court announced in November 2014, nominating them as co-accused in the high treason case.

The IHC bench, comprising Justice Noorul Haq N. Qureshi and Justice Aamir Farooq had earlier reserved the verdict in the case on October 19.

Earlier, Additional Attorney General Afnan Karim Kundi had submitted before the IHC that the federal government was ready to examine the role of any abettor in the imposition of the 2007 emergency.

The trial in the treason case was stopped in December 2014 when the IHC admitted three identical petitions filed by Shaukat Aziz, Abdul Hameed Dogar and Zahid Hamid against the special court order.

Later on October 27 this year an order by the special court stated: “In view of the fact that the judgment of the Islamabad High Court is awaited, these proceedings are adjourned to November 27, 2015 at 9:30.”

The special court, hearing the treason case against former military ruler Gen (retd) Pervez Musharraf, on October 15 2014 had demanded for a collective trial of all accomplices of the former president

The special court had used the word “selective investigation” which the government wanted to be expunged.

Musharraf had demanded that the civilian leadership and the military authorities that allegedly abetted in the imposition of the November 3, 2007 emergency should also be tried along with him.

According to the proclamation issued for the November 3 emergency, Musharraf imposed the emergency after consulting the then prime minister, the governors of all four provinces and the chairman of joint chiefs of staff committee, the chiefs of the armed forces, the vice-chief of army staff and the corps commanders of the Pakistan Army.

I support Sir Musharraf. But he made a mistake coming back to Pakistan. He should have stayed away and enjoyed his life. Why did he care enough for this country to come and suffer like this.

Selective justice will not serve this country we have already seen this in Zulfiqar Ali Bhutto case when selective justice was done and the nation and country is still reaping the fruits of that selective justice a single person cannot run the country of such a large population without the help of other people in power

This Legal Drama is already in the limbo with Musharaf falling on so called medical conditions to avoid court appearances and each time the court allows his application thus it will go no where and there will be No Justice done , No justice Served and No justice Seen to be served .In the mean time , lawyers on both sides will milk millions from the Govt kitty as well as Musharaf's pocket and the time will come the case will have No bearings what so ever on any body cos if one has to accept Musharaf's medical conditions as stated to court , he is a sort of just one beat missing scenario from his ailing heart and if that heart gives up , there will be No prime suspect to be tried and hence the case will end there .....

It is sad that a patriot General Musharaf is being tried for treason who defeated Indian forces and took back Kargil by force. This honest leader is being dragged in courts who is not involved in one cent corruption while Politicians who are convicted for money laundering and corruption are at the helm.

Current civilian leadership are really afraid of General Musharaf because of his honesty & bravery. The bigiest mistake Genral Musharaf made was NRO deals made with the people, now these same people are looking to make another NRO deal with another great honest and brave Army general of Pakistan,Raheel Shareef, but this time all these people will be locked up in jails for forever.
