KARACHI, Dec 10: Justice Shabbir Ahmed of the Sindh High Court restrained on Monday the registrar land of Landhi division from executing or registering transfer deed concerning a piece of land on which a housing project, Green Park City, was planned/announced.

The judge was hearing a suit filed by plaintiff Abdul Latif Brohi against defendants Ali H. Mandviwala and Rizwan Haqqi.

The plaintiff moved the court stating that the defendants had mortgaged the property with him against a sum of Rs3.5 million as their project (Green Park City) was not selling as they anticipated. They mortgaged the property bearing survey Nos 102,103,104, 280,281, 301,302,303, 320, 321 and 323 Deh and tappo Landhi Taluqa and district Malir.

The defendants failed to redeem the mortgaged property and instead they sold the plot bearing survey number 103 and intend to sell/dispose of the remaining land though the original documents were with the plaintiff. The plaintiff submitted that the defendants had approached the deputy registrar for approval of lease deed on the basis of photostat documents.— APP
