PESHAWAR, Aug 9 The Peshawar High Court Chief Justice Ejaz Afzal Khan stated on Monday judges for the Darul Qaza in Malakand Region would be appointed once the provincial government provided them infrastructure and staff for that purpose.

Justice Afzal told media persons here delay in functioning of the Darul Qaza was because of lack of provision of staff and infrastructure by the government.

Following inauguration of the new judicial complex here on the Khyber Road, the chief justice said for clearing backlog of cases they had divided the pending cases in three categories.

He stated the first category included cases instituted before 2000 and had still been pending. He added they had directed all the courts to dispose of those cases before Dec 31. The second category included cases instituted between 2000 and 2005, whereas the third category included cases instituted after 2005.

Earlier, addressing the inaugural ceremony Mr Afzal stated the administration of the justice was the chief goal of the judiciary, but at the same time, elimination of injustice, oppression and atrocity could not be overlooked.

He said many men and women having genuine grievances had shunned the idea of approaching courts because of the difficulties they faced while doing so.

“Many of the litigants relinquish their claims or settle their disputes by agreeing to get less than what is their due simply because the basic amenities of life are not available near or around the courts.

How pathetic that situation would be where people forgo and forsake the enforcement of their rights because of inadequate arrangements or complete lack of basic facilities,” he said, adding, keeping in view this it was decided to establish better infrastructure across the province.

The top adjudicator of the province said “The complex we inaugurate today is an expression of that humble effort. In any case, it is not an end per se, it is just a means to achieve the most cherished goal of administering justice between citizen and the citizen on the one hand and citizen and the state on the other.”

He said, 'let's focus on making the courts of law as the courts of justice'. “Now we have a good number of courts well-equipped with all necessary facilities, let's not forget the purpose of creating death and life which in the words of Quran is nothing but a test to see who amongst us is balanced in his conduct,” the PHC chief justice added.
