Appointment of LHC judge challenged

Published December 4, 2001

ISLAMABAD, Dec 3: Appointment of Justice Karamat Nazir Bhindari as judge of the Lahore High Court was challenged in the Supreme Court on Monday.

The petitioner, Dr Amjad Hussain Bukhari in his writ petition under Article 184 (3) of the Constitution, prayed to the apex court to declare the appointment of Justice Bhindari void ab initio.

The filing of the petition has given a new twist to a pending writ in which Justice Bhindari and Justice Amir Alam have challenged the seniority of Justice Mohammad Nawaz Abbasi.

The petitioner, Dr Bukhari, stated in his writ that appointment of Justice Bhindari as additional judge of the LHC was not proposed and recommended either by the acting chief justice of LHC nor the chief justice of Pakistan at “relevant time”. His name was later on included in the final summary on the dictates of the then prime minister, Benazir Bhutto, against constitutionally-prescribed consultative procedure, he added.
