PESHAWAR, Dec 6: A single bench of Peshawar High Court on Thursday dismissed bail petition of a man charged with planning a robbery at the residence of a retired schoolteacher in Charsadda.

The bench comprising Chief Justice Dost Mohammad Khan observed that the accused, Sajjad Khan, was not entitled to the concession of bail keeping in view the evidence on record.

The petitioner was arrested in connection with a robbery in jurisdiction of Tangi police station in Charsadda on April 26, 2012. The robbery was committed at the residence of one Ghulam Mohammad, a 75-year-old retired schoolteacher.

The police claimed that three robbers had forcibly entered the residence of the complainant and taken away 17 tolas of gold ornaments and cash. Later, three suspects were arrested. In their confessional statements they stated that a relative of the complainant, Sajjad Khan, had planned the robbery.

The complainant’s counsel, Saifullah Cheena, contended that the accused/petitioner was named by the arrested suspects in their confession before a magistrate.

Meanwhile, the bench dismissed bail petition of a suspect and granted bail to a co-accused in a case of narcotics trafficking. The local police had arrested the two suspects, Sabir Shah and Dr Khan, while they were travelling in a pick-up vehicle. The police claimed to have recovered 16 kgs of charas from the vehicle.

Advocate Nek Nawaz appeared for Dr Khan and contended that he was travelling in the pick-up as passenger and had no knowledge of the presence of narcotics. He said that the vehicle was driven by Mr Shah.

The bench dismissed bail petition of Mr Shah and released Dr Khan on bail.

The same bench also dismissed bail petition of a suspect, Siraj Gul, who was accused of smuggling narcotics in Kohat district. The police stated that Ustarzai police had recovered 10 kgs of charas from a van which Mr Gul was driving.
