ISLAMABAD, March 10: Another petition has been filed with the Lahore High Court (LHC)’s Rawalpindi bench seeking restraining order against the trial of Brigadier Ali Khan by the military court.

The LHC fixed for hearing the miscellaneous petition before the single bench of Justice Mazhar Iqbal Sindhu on Monday.

In the petition, Colonel (retired) Inamur Rahim, the counsel for Brig Ali, stated that due to his engagement in GHQ attack case before a two-member division bench he could not appear in the court of Justice Sindhu on March 8. He requested the court for grant of interim relief of staying the military court proceedings till the final disposal of the case.

Talking to Dawn, Colonel Rahim said military authorities had moved Brig Khan from his detention centre in Sialkot to the Armed Forces Institute of Cardiology (AFIC) in Rawalpindi. He, however, said his client was not being treated in accordance with the protocol of his rank, adding instead of keeping him in one of the rooms reserved for senior military officers he had been kept in the civilian section.

He said the military authorities had admitted him in the hospital with the fake identity of ‘Feroz Khan.’

The counsel alleged that the authorities also stopped him from meeting his ailing client which was against the fundamental rights of the petitioner.

He said around 10 ex-servicemen had formed a four-member committee to protect the rights of the detained brigadier and the number would gradually increase in the coming days.

Meanwhile, Colonel Rahim, Advocated Tariq Asad and other lawyers of seven convicts in the GHQ attack case circulated a notice in different bar associations criticising the powers of the chief of army staff (COAS) to decline a request for supply of the copies of trial proceedings to the convicts.

It said even the court concerned had observed that how the counsel for the convicts could prepare their arguments for appeal against the conviction without the copies of trial proceedings.
