ISLAMABAD, Nov 28: The People’s Party Parliamentarians (PPP) will file a case in the Supreme Court seeking disqualification of the 10 party dissidents on the basis of Article 63 of the Constitution, which is still in abeyance.

In the meanwhile, the PPP will announce on Saturday a disciplinary action against Faisal Saleh Hayat, Rao Sikandar Iqbal and Nauraiz Shakoor who are the members of its central executive committee.

Some legal experts had already been asked to prepare a case against the dissidents who had voted for the PML-Q’s premier in violation of the party discipline, PPP spokesman Farhatullah Babar told Dawn .

He said that since all the 10 dissidents were the members of People’s Party Parliamentarians, therefore the action had already been initiated against them by the PPP.

The first step under the defection laws was taken on the day of prime ministerial election, when Parliamentarians President Makhdoom Amin Fahim wrote a letter to the dissidents and provided its copy to the National Assembly Speaker.

In case the Speaker refused to initiate action and referred the case to the Chief Election Commission on the pretext that Article 63 of the Constitution was not in operation then a case would be filed in the Supreme Court of Pakistan, he added.

Party’s legal and constitutional experts were of the view that the Constitution could not be restored in parts.

The spokesman said the action against the dissidents was being taken on three parallel tracks. He said Saleh Hayat, Sikandar Iqbal and Nauraiz Shakoor were the members of PPP Central Executive Committee, therefore action against them would be taken under the signatures of the acting secretary-general of the People’s Party, Raza Rabbani.

A seven-day notice to these three dissidents seeking an explanation for violating of the party discipline had been issued by Raza Rabbani last week which had expired on Thursday, he said.
