PESHAWAR, June 28: The Gomal University, Dera Ismail Khan, on Tuesday submitted before the Peshawar High Court the inquiry report about the graduation degree of senior provincial minister Rahimdad Khan.

An official of the university appeared before a two-member bench comprising Chief Justice Ejaz Afzal Khan and Justice Yahya Afridi and submitted the report.

The said report was produced in a writ petition filed by a voter, Farman Khattak, challenging the election of Mr Rahimdad as an MPA in the 2008 general elections. He has requested the court to disqualify Mr Rahimdad as he was not a graduate, a precondition for contesting the election.

Advocate Abdul Lateef Yousafzai, representing Mr Rahimdad, requested the court that he would need time to go through the said report and requested that a copy may be provided to them.

Advocate Qazi Mohammad Anwer appeared for the petitioner and stated that they would also go through the report.

The bench was requested that as Mr Yousafzai and Mr Anwer were going abroad early next month, a date be fixed for the next hearing prior to summer vacations. The bench turned down the request and fixed Sept 9 for next hearing.

Meanwhile, the bench also adjourned till Sept 9 hearing of a writ petition filed by Mr Rahimdad challenging an order of the election tribunal in which it had summoned the report of the said inquiry.

The court had earlier restrained the election tribunal from examining the report.

Similarly, the bench also adjourned hearing of another writ petition challenging the election of provincial minister Sher Azam Wazir on the ground that he possessed fake graduation degree and was not qualified to hold the office of MPA. The petition is filed by Waheedullah Khan, a voter of his constituency in Bannu.
