LAHORE, Sept 26: The Lahore High Court directed Capt Syed Jawad Husain Rizvi on Thursday to file reply to the contempt notice positively by Sept 29, failing which ex parte action would be taken again him.

Justice Khwaja Muhammad Sharif judge issued the orders when the army officer failed to submit an answer to the showcause notice served on him during the last date of hearing.

Capt Rizvi and his counsel submitted that contempt notice had not been served on them till date.

Justice Sharif observed that there was no need to issue a fresh contempt notice as it had been given when both the counsel and the respondent army officer were present in the court on the last date of hearing.

The contempt notice was issued to the army officer for failure to appear before the court despite the receipt of a notice in the case filed by his wife Nabiha for the possession of their three years old daughter taken away by him in violation of the orders of the guardian judge.

Capt Rizvi appeared before the court when a bailiff visited his residence in Risalpur and recovered his daughter on the orders of the LHC. The bailiff also complained about the behaviour of the army officer with him when he contacted him for the production of his daughter in the court.

Justice Sharif gave the girl in the possession of her mother and issued a contempt of court notice to Capt Rizvi. — Reporter
