Nomination of Nisar for NA-53 challenged

LAHORE, Sept 9: A Lahore High Court election tribunal on Monday issued a notice to former petroleum minister Chaudhry Nisar for Sept 11 on an appeal against his nomination for NA-53 (Rawalpindi).

The appellant, Khalid Khan, said Mr Nisar had disclosed in his nomination papers that he had obtained a loan of Rs1.496 million from his brother to purchase a plot in LUMS Housing Society.

Mr Khalid claimed that under Section 12(18) of the Income Tax Ordinance 1979, any loan of Rs100,000 and above was to be considered the borrower’s income unless transacted through a cross-cheque or a banking channel. The respondent had thus made an incorrect declaration of income.

The appellant further argued that Mr Nisar, the owner of a 403-kanal piece of agriculture land, had not disclosed if he had paid land revenue for the last three years.

It was pleaded that Mr Nisar did not qualify to contest elections under Section 12 of the Representatives of People’s Act 1976. Mr Nisar would submit his version on the next hearing.

Another tribunal adjourned the proceedings on an appeal filed by Chaudhry Nisar against the validity of Intermediate degree of his rival candidate Ghulam Sarwar until Sept 11. The respondent has been asked to prove the validity of his degree on the next hearing.

Some 11 appeals were dismissed and five allowed by LHC tribunals on the eighth day of hearing of appeals against the decisions of ROs.
