ISLAMABAD, May 8: The Federal Tax Ombudsman (FTO), Justice (Retd) Saleem Akhtar, has asked the Central Board of Revenue (CBR) to direct the taxation officer to carry out proper assessment of the income of a complainant.

The decision was taken on the complaint of M/s Karachi Fertilizer Agency, Khipro which complained against the assistant commissioner of income tax, Sanghar for not accepting his returns of income for the assessment years 2000-01, 2001-02 and 2002-03 under self-assessment scheme.

The FTO said that it was established that the assessing officer made the assessment for the year 2002-03 in very irresponsible manner without observing the legal requirements - issuance and service of statutory notices and passing a legal and proper order.

The justice recommended to CBR to direct the zonal commissioner of income tax to cancel the tax demand created under income tax ordinance and direct the taxation officer to pass a proper assessment order after service of statutory notices and enquiries regarding the extent of business. The assessment pending for the year 2001-02 be also completed in accordance with law.

The compliance be reported to this office within 30 days of this order, added the FTO.
