PESHAWAR, July 21: A two-member bench of the Peshawar High Court on Wednesday put on notice the NWFP advocate general and deputy attorney general in a habeas corpus petition filed against alleged illegal detention of a person by an intelligence agency.

The petition was filed by a jeweller of D.I. Khan, Wasif Khan, stating that his son Mohammad Yousaf had been in the custody of the Military Intelligence since May 28 and his whereabouts were not known.

Advocate Saadullah Marwat appeared for the petitioner and contended that the detainee had not been produced before any of the courts and the reason for his arrest had not been given. He added that under the law the detainee had to be produced before the court within 24 hours of his arrest.

The military intelligence through the commanding officer, Peshawar, the provincil police and other intelligence agencies including the Inter Service Intelligence and Intelligence Bureau have been made respondents in the petition.

The petitioner stated that in the night between May 27 and 28 his house in D.I. Khan was raided by police officials along with some intelligence officials. He claimed that his two sons Mohammad Yousaf and Jawadullah and his servant Mohammad Rafique were taken into custody by the raiding team.

The petitioner stated that the three detainees were taken to police station D.I. Khan Saddar from where they were allegedly taken away by officials of the MI. He added that later on except Mohammad Yousaf the other two detainees were released.

Despite their repeated requests, the petitioner claimed, the concerned authorities had not been informing them about the charges against the detainees. The petitioner stated that he came to know that the intelligence agencies suspected that some telephone calls were received at his shop from an absconding leader of a banned outfit, Lashkar-i-Jhangvi, Lateef Baloch, who was carrying head- money of Rs5,00,000. The petitioner claimed that they got nothing to do with the banned organization.
