ISLAMABAD, April 2: Civil Judge Syed Muzaffar Ali Shah on Monday set aside an earlier ex parte decision of the court that had favoured a construction company against the principal of Islamabad Grammar School in a property dispute.
The court in its order observed that the construction company in its suit for obtaining ownership of a piece of land had failed to provide the correct address of Islamabad Grammar School, hence many court notices could not reach the principal.
Ms B. A. Qureshi, the principal of Islamabad Grammar School, through Supreme Court Advocate Naeem Bukhari, submitted before the civil court that she had been allotted a plot for her school during Benazir Bhutto’s second stint as prime minister.
The petitioner said that the respondent, a construction company by the name of Win Force, had sought to purchase her plot. She said she arrived at a preliminary understanding with the company and received Rs2m as the first instalment, which, she claimed, was 20 per cent of the total amount that the company had agreed to pay her.
She said that the company did not pay the rest of the amount and approached the civil court for acquiring a declaration of ownership of the plot on the basis of the sales agreement between the two parties.
Withdrawing its earlier decision, the court issued notices to the company to file a reply till April 15.
The land in dispute is situated in the vicinity of Bekha Syedan village in Western Islamabad.— A Reporter
