HYDERABAD, Aug 23: The additional district and sessions judge-I of Hyderabad on Thursday ordered the SHO of Matiari to appear in court on Aug 25 and file comments on charges of violation of its orders while the DPO undertook before the judge that he would transfer the SHO.
The judge gave the directive on an application filed by Pir Ghulam Mujaddid Sarhandi claiming that the SHO did not comply with court's Tuesday order.
The judge had ordered on Tuesday to register an FIR against district nazim, DPO, and SHO of Matiari if it proved they had committed a cognisable offence.
The order was passed on a separate human rights application earlier filed by the same applicant when, according to him, his rival Zulfikar Ali Shah Jamote, Matiari DPO Javed Odho and SHO Jiandal Shah with 15 to 16 police mobiles attacked him and his brothers, resorted to heavy firing on their house before taking away his brothers.
The SHO insisted that he had not only complied with Tuesday's order but also informed the court of civil judge and judicial magistrate concerned about the action he took in the matter.
When the applicant's counsel pointed it out to the court that the SHO had not produced a copy of the FIR, the judge asked him to get it verified by the concerned court and allowed him to file an application if it proved the order was not complied with.
The counsel verified the facts and then filed an application after which the court ordered the SHO to appear on Aug 25 with comments.
The court asked police to produce detainees in court on Friday on the second application filed by the same applicant against torture of Sarhandis arrested on Tuesday. The DPO, meanwhile, submitted to court a list of 21 cases against Sarhandis.
The SHO of Matiari, Jiandal Shah, told Dawn that nowhere in the said order was it written that the FIR should be lodged. The order said that action should be taken if a cognisable offence was committed, he explained.
The DPO confirmed that he had submitted in the court that he would replace the SHO if he had committed any wrongdoing. The Sarhandis arrested on Tuesday had either been remanded to judicial custody or were being interrogated in police custody after being remanded by concerned court, he said.
