HYDERABAD, Aug 15: The Hyderabad circuit bench of the Sindh High Court on Wednesday issued notices to regional police officer (RPO) of Hyderabad, DIG of Mirpurkhas, SP investigations of Sanghar, In-charge of investigation team of Hatri police station and one Shahid Ahmed to appear in court on Aug 22.

Nauroz Khan, a truck owner, who was represented by Ghulamullah Chang Advocate said in his constitutional petition that his drivers, Aijaz and Ghani, were taking 36 tons of sugar to Swat following an order from Super Mardan Karachi Goods on Aug 2, 2006 when they met with an accident and the sugar fell into a ditch in the area of Lakhi Ghulam Shah police station. A report was field to this effect on Aug 3, he added.

He said that despite the fact that the sugar, which had remained unspoiled in the accident, was delivered in Swat, Mr Malik, owner of Super Mardan Karachi Goods, lodged an FIR on Oct 19, 2006 accusing him and his drivers of misappropriating Rs1.4 million worth sugar.

The petitioner said that concerned investigating officer, Mazhar Mehdi, had brought the truck (C-2146) from Sadiqabad after getting it released by concerned magistrate and the case was being investigated by SIP Ghulam Nabi Panwhar, who also visited Lakhi Ghulam Shah police station during his investigations.

He said that the police officials were investigating the case honestly when the complainant, Mr Malik, again filed a criminal miscellaneous application on April 12, 2007 with sessions’ judge of Hyderabad seeking impartial investigation of the case.

Police denied the allegations in the court insisting their investigation was impartial and they had found that no misappropriation of the commodity had been committed. The complainant's council, however, prayed the court to shift investigation to Sanghar district.

The petitioner informed that on May 1, 2007 the complainant again lodged an FIR against him at the Peero Mal police station following which Sanghar investigation police seized the truck back from Hatri police and were trying to arrest him and other people nominated in the FIR.

Mr Khan said that the complainant was a man of questionable character, selfish and greedy and prayed the court to order quashment of FIRs and direct the respondent in-charge of investigation police Peero Mal police station to release the truck immediately.

He said that the proceedings should be started against the complainant and police should be restrained from harassing the petitioner, his family members and employees.
