KARACHI: Varsity restrained

Published April 11, 2007

KARACHI, April 10: Another division bench consisting of Chief Justice Sabihuddin Ahmed and Justice Gulzar Ahmed, meanwhile, restrained the NED University from filling the vacancy created by the dismissal of assistant professor Asif Ali.

The petitioner submitted through Advocate M. Nawaz Shaikh that his services were terminated by the vice-chancellor and the syndicate on October 6, 2006, under the old efficiency and discipline rules, which had been impliedly repealed by the Removal from Service (Special Powers) Ordinance, 2000. No proceedings under the 2000 ordinance were conducted and he was arbitrarily removed from service.

Issuing notices to the respondents for April 20, the bench directed that the vacancy would not be filled in the meantime.
