PESHAWAR, Dec 15: The Peshawar High Court on Friday dismissed a petition seeking cancellation of bail granted by a lower court to a surgeon charged with illegal removal of a child's kidney.

Justice Shahjehan Khan Yousafzai observed that the defendant was entitled to the concession of bail.

Ziarat Gul, father of the boy, Ameenullah, in his petition stated that the doctor had removed kidney of his son without his consent.

He requested the court to overturn an order by the additional district and sessions judge whereby the accused, Dr Ali Gohar, was granted a pre-arrest bail.

The doctor had filed the pre-arrest bail petition before the court of additional district and sessions judge after an FIR was registered against him at the University Town police station.

His bail was confirmed by the lower court on Aug 11. The FIR was registered on June 27.

The petitioner's counsel contended that the accused was directly charged in the case, adding that the subordinate court had erred in confirming the pre-arrest bail of the accused.

The father of the boy stated that he had taken his son to the surgeon, who operated the boy a few days ago at a private hospital in the jurisdiction of University Town police station.

He alleged that as the boy was not feeling well they took him to a government hospital, where they were informed that one of the boy’s kidneys had been removed.

The doctor refuted the allegation. His counsel argued that ultrasound examination of the boy, conducted by a known specialist, showed that one of his kidneys was dead.

He added that to further confirm the report another ultrasound was conducted which verified the same facts.
