HYDERABAD, Nov 9: Justice Amir Hani Muslim of the Sindh High Court Hyderabad circuit on Wednesday appointed SP (security) Abdul Khaliq Sheikh to inquire into allegations levelled by a petitioner against police officers and record his findings as to whether the petitioner was falsely implicated in different cases.

The judge asked the petitioner to examine his witnesses before the inquiry officer and the respondents would also be at liberty to examine their witnesses.

The officer will record findings to be concluded within four weeks from the date of communication of the order.

The court said that the inquiry report should be submitted by December 15 before the additional registrar.

The order was passed on a petition filed by Anwar Ali Dahiri, requesting the court to set aside the Feb 10 order of the Nawabshah sessions judge and direct him to restore the previous order of Feb 7, about the registration of case against policemen.

He requested that operation of the second order, ordering proceedings against him, should be suspended.

He said that on the application under section 22-A Cr.PC on February 7, against Daur TPO Mazhar Hisbani, 12 police and private personnel for lodging FIR, the sessions judge Nawabshah directed the SHO concerned to register case but he did not register the FIR and the accused approached the sessions judge against the order.

He said that on February 10, the court suspended earlier order and on the petition the high court directed the sessions judge to expedite proceedings in criminal miscellaneous application, filed by the applicant against the TPO and others and submit report in three months.

For compliance of the order, he said, the sessions judge appointed the civil judge and the judicial magistrate-I inquiry officer, who after recording evidence of parties submitted the report on March 21, supporting the petitioner’s version.

He said that the judicial magistrate reported that the TPO and the applicant were involved in a dispute, leading to implication of the petitioner in false cases.

He said that he was not convicted in any single case.

He told the court that on the application of TPO and others on March 26, the matter was sent back to the civil judge, who re-conducted the inquiry and sent report to the sessions judge, observing that allegations against the applicant had become doubtful.

He said that in fact allegations against him were related to crime no 19/2004 in which he stand acquitted as charges were not proved.
