LARKANA, May 22: District Naib Nazim Munwar Ali Abro in a petition filed in the Larkana circuit bench of Sindh High Court on Monday said that some provisions of the Sindh Local Government Ordinance were inconsistent and contradictory to certain articles of the Constitution.
Advocate Inayat Morio filed the petition under article 199 of the Constitution on behalf of the district naib nazim.
The petitioner said that provisions of section 24, 63, 85 and 92 of SLGO 2001 were in contrast to its section 47 and 72.
He said that certain provisions of the SLGO-2001 were not only inharmonious with some articles of the ordinance but in contrast with articles 4(A), 25, 35(7) c and 95 of the Constitution.
He said that by inserting section 4 A of section 42 through amendment in SLGO-2001 the convener of district council was put under pressure by the district nazim.
He said that the naib nazim could not perform independently.
He said that in the section of no-confidence motion the taluka nazim, town nazim, and district naib nazim had been discriminated and protection was given to the district nazim, taluka nazim, union nazim and union naib nazim without any lawful jurisdiction.
The petitioner prayed the court to declare that the provisions of section 24, 63, 85 and 92 were inconsistent to the section 47 and 72 of the SLGO-2001.
Meanwhile, the district naib nazim cancelled tenders for setting up shelter-less schools in the district.
In a letter to the district coordination officer, he said that the district council in its session said that without declaring appropriate locations of shelter-less schools no tender would be issued.
