PESHAWAR, May 18: The Peshawar High Court on Thursday dismissed as premature a writ petition of Salma Babar, an MPA who had been expelled from the People’s Party Parliamentarians for violating party discipline in Senate elections.

She had requested the court to restrain the NWFP Assembly speaker and others from taking any action against her.

Ms Babar alleged that she was detained in the Chief Minister House and was escorted to the assembly by security guards on the polling day.

A two-judge bench, comprising Chief Justice Tariq Pervez Khan and Justice Ijaz Afzal, observed that cause of action for the petitioner was yet to arise.

“How can the court issue an order without any written order by the speaker or any other respondent,” the bench observed. However, the court allowed Ms Babar to file a fresh petition if any action was taken against her.

The PPP had expelled two women MPAs last week for violating party discipline.
