ISLAMABAD: The tenant of a bus stand near Faizabad has moved the Islamabad High Court (IHC) filing an appeal against the decision of the civil judge.

As per details of the case, the owner of the land, Raja Shahid, rented out a bus stand on Karnal Sher Khan Road (formerly known as I.J. Principal Road) to Raja Shabbir.

However, when the owner retrieved his land by terminating the lease deed due to non-payment of rent and evicted Shabbir from his land, the latter moved a civil court and surrounded the property with the help of his supporters.

Civil Judge Syed Mohammad Zahid Tirmizi on May 27 issued a stay order in favour of landlord Raja Shahid which was confirmed on July 6.

Interestingly, the tenant has earlier filed three suits in three different courts and obtained stay orders from every court.

The tenant, Raja Shabbir, filed an appeal against the order of the civil judge which was dismissed in limine by the additional district and sessions judge (ADSJ).

In the order sheet, the judge noted that Shabbir had earlier filed three legal suits in three different courts – two in Rawalpindi and one in Islamabad – and obtained a stay order from all these courts.

However, while reproducing contentions of the counsel for the landlord Raja Shahid, the judge stated in the order sheet that Shabbir obtained the stay order from Rawalpindi by submitting forged documents for which he was also facing a criminal case and was on pre-arrest interim bail.
