PTI response

Published December 11, 2016

THIS is with reference to your editorial of Dec 9 on the Panama Commission.

PTI has not only produced evidence in support of its case but also demolished through reasoned legal arguments the defence presented on behalf of the prime minister and his family.

The PTI’s documentary evidence includes by way of illustration:

An English High Court Judgement recognising the ownership of the Mayfair apartments by the Sharif family as far back as 1999 in litigation involving Hudabiya, which was owned and managed by the prime minister’s daughter and other family members at that time.

Land registry documents showing ownership of the apartments by two BVI companies which compelled the prime minister and the respondents to admit ownership albeit from 2006 rather than the early 1990s.

Letters written by and to the BVI Financial Investigation Agency which prove that the prime minister’s daughter is the ‘beneficial owner’ of the two BVI companies and hence of the Mayfair apartments.

A board resolution of one of these BVI companies which was passed and signed by the prime minister’s daughter as sole shareholder.

A document signed by Mrs Mariam Safdar intended for beneficial owners which she submitted to Minerva Financial Services Limited, a company from the same group which is now shown as shareholders of the two BVI companies.

Official records from Companies House in the UK of Flagship and several other companies which show that Hasan Nawaz Sharif was involved in real estate business well before 2006.

An analysis of the disclosed sources of income and expenses of the prime minister’s daughter which establishes that in reality she has always remained a dependent of her father.

Additionally, the PTI’s counsel has demonstrated from the respondents’ documents that the Dubai Steel Mill was a commercial disaster which could not have yielded any funds for investment in Jeddah or Qatar. This is the foundation of the PM’s defence.

It was in view of the above submissions that three crucial questions were orally raised by members of the bench. In reply not a single question has been answered to-date by the counsel for the prime minister whose replies were evasive.
