HYDERABAD, Nov 14: The Sindh High Court, Hyderabad circuit bench, on Friday issued notices to the police officials of Mirpurkhas and Sanghar districts in two separate constitutional petitions, seeking registration of a criminal case against police officials and transfer of a case to some honest police official.

In one of the petitions, Mehrab Khan cited the DPO, Sanghar; the SHO, Lundo police station, and Mohammad Hassan Zardari as respondents.

He said that Zardari was an influential landlord who wanted his land by hook or by crook.

According to his petition, two years back Zardari and his associates increased pressure tactics upon him and his relatives to harass him.

His application, submitted to the SSP, Sanghar, remained in cold storage. But on the contrary so as to punish him, Sub-inspector Noor Mohammad Mari and ASI Qurban Rajar along with other four police constables raided the houses of the petitioner and his cousin. The petitioner, his brother, Noor Mohammad; nephew, Ghulam Hyder, and cousin, Allah Warayo, and others were illegally arrested and confined unlawfully in the Lundo police station.

He said a false FIR was also lodged on the complaint of Mohammad Hassan Zardari.

He alleged that he and the other detenus were tortured by the private respondent and his relatives.

He said that they were released following payment of Rs50,000 as bribe.

He said the petitioner, his brother and relatives received injuries and that when they approached the SSP, Sanghar, he transferred investigation of the FIR to the CIA, Sanghar, which was finally disposed of as cancel class.

He prayed the court to direct SHO Sanghar police station to register an FIR against SIP Noor Mohammad Mari, the ASI and other policemen.

In the second petition, Mohammad Anwar cited DPO (investigations) Mirpurkhas, Taluka police officer (investigations) Digri and in charge, investigation officer, Digri police station, as respondents.

He said that police were not investigating fairly a case (FIR 78/03), lodged by Fateh Mohammad, his relative, and were favouring the accused party.

He added that Fateh Mohammad had been remanded to judicial custody in a counter case, lodged against him and the petitioner.

He said that police officials prepared a summary for his case, crime No78/03, for disposal as B-class and even the judicial magistrate and First Class Magistrate did not agree with the police’s contention.

The petitioner said that despite directives of the magistrate, the respondent police officials did not submit the charge-sheet of the case and were still making efforts to secure false evidence to get crime No78/03 disposed of. He prayed the court to appoint some gazetted police officer and transfer the case to him for investigation.

The court issued notices on both the petitions for Nov 17.
