Imran ‘makes jibe’ at land owners

MIANWALI: Pakistan Tehreek-i-Insaf Chairman Imran Khan has warned land owners to sell four acre land to the Namal University otherwise “we will acquire it under section 4 of Land Acquisition Act.”

Addressing the 3rd convocation of Namal University here on Sunday, he said: “The completion of Knowledge City of Namal University is my passion and politics is my mission.

“Four acres are lying in front of the university building but owners are reluctant to sell the land.”

He distributed degrees among 68 students. He urged the students to utilise their abilities for the country.

It was learnt that Imran Khan deputed PTI MNA Amjad Khan to convince the people to sell the land to the university but owners were demanding ‘high’ price.

Talking to Dawn, Sillo clan elder Malik Ghous Sillo said his ‘biradri’ had already donated land to Imran Khan for establishing Namal University “but now due to his attitude we refuse to sell land at throwaway price. We had demanded land in exchange for land to construct houses instead of selling it.”

IK should not make irresponsible statements. Namal University is a private educational institution and must negotiate with the land owners if it desires to purchase land. The land owners have full rights of ownership including the right to refuse selling their assets. Land Acquisition Act can only be invoked by the government to forcibly acquire privately owned land for projects of national importance like building roads and highways and even then the government is required to pay the fair market price to the owners.

@Umer - Please educate yourself, NAML is a non-profit organization rather than a business before trying to be smart. IK said it in a lighter mood btw. We know very well the nature of our people, they try to exploit every opportunity, they were presented the fair deal but want to take undue advantage.

@AW Whatever Imran Khan thinks is of great national importance. His personal passions are a national asset. When he announces wedding plans from his container, the wedding becomes a national event. Divorce, however, is a different story. It is very up close and personal. The 2007 Lal Masjid operation was launched because the Masjid administration was accused of illegally occupying and annexing adjacent plot of land to build a student library. Going by IK's rule of "sell it or lose it" there seemed nothing wrong with the action of Lal Masjid administration. Moreover all land grabbers including those who indulged in China Cutting also stand "vindicated". Bravo IK!

@Arif Such provision is almost universal, to avoid excessive 'hostage taking' by property owners. Ideally the owners should be able to acquire alternate land to serve their needs. "land in any locality is needed or is likely to be needed for any public purpose or for a Company [ie business] , ... " In some parts of the world this is called eminent domain, whereby property can be 'taken' at a price determined by the 'tax' authorities.

The land can be acquired through Land acquisition collector for a public purpose, if it is required by a corporate body, an educational institution in this case, which can apply to the collector for initiating such a process justifying such a need and a public purpose. It cannot be construed as a threat for expressing a resolve to a resort to legal course, though it may be a time consuming process involving some litigation as well. However it was better if Imran Khan had avoided to make the issue public. It is better to negotiate all agreements privately, but arrived at publicly.

@Ahmad You can give your savings and your house if you care so much for Pakistan . Charity should begin at h9me. This poor family has already donated 28 kanals to this university. All they have is this land, and they don't have know how to collect Donations overseas and build hospitals and put their mother's name. To me this is also a kind of corruption.

WOW....so what Imran approves of legal plunder. Namal University is a private institution. What Imran is advocating is called totalitarianism and under it plunder is legal because the state says so. Pukhtuns have voted you to power but if your passion is plunder and coercion then you should know a fatal blow to ambition of power will be struck come next elections.

IK attitude is obvious since he entered in politics. He always maligns and undermines his opponents in speeches and general talks and one can observe his rude, rough, arrogant behavior. I am sure he cannot talk and behave in this way while in UK or any western country. He started talking in his usual style (like mola jatt) with common people. People are seeing his behavior very closely and thinking how the 'future PM' would be looking like.

@Arif it is Land Acquisition Law's section. But he will be required to pay still. Section 4. Article (3) The officer so authorised shall at the time of such entry pay or tender payment for all necessary damage to be done as aforesaid, and, in case of dispute as to the sufficiency of the amount so paid or tendered, he shall at once refer the dispute to the decision of the Collector or other chief revenue officer of the District, and such decision shall be final].

I remember the scene when IK stormed a police station in Islamabad and took his arrested followers away, while those arrested were already legally charged and supposed to be presented in a court of law the following day. We also remember how a jail-break was officially facilitated in KPK in order to get hard-core Taliban out. And now we have seen him publicly threatening a community to surrender their property. Safe to assume that if PTI ever comes to power then we will see PTI supporters burning police vehicles, grabbing land for IK's pet projects, and inaugurating Taliban offices all over the country.

Nausherwan was building a palace but there was a little hut of an old lady and she did not want to sell her abode. The king did built the palace but left the small hut and the corner of the old lady. IK has gone insane and talks nonsense all the time and THINKS that he is right and everyone else wrong.

@Ahmad I'm quite surprised at your statement. It is private land owned by the families. It is their free choice to put up a price on that land. If an individual wants to purchase it, he can do so by all means but he has to pay the legitimate price which could be whatever as put up by the owner of the land.

IK also insulted the local people saying that unless they agree with his vision, they would be herding sheep forever. God, so much contempt for poor villagers. So what if they herd sheep?? They are better than those who roam the globe begging around in the name of funding welfare projects (and then investing those funds into politics and real estate projects in Oman).

Everyone knows that quality education at university level is in short supply in Pakistan. We should be thankful to IK for setting up a non profit university in a backward region,a SADQ-JARIA venture.As, such we should all appreciate, support & CONTRIBUTE to such initiatives for national development. Now,the university can not be expanded without getting more land. And, if the land owners are not willing to sell the land to the university at reasonable price, either the plans for expansion will have to be abandoned OR the university must be relocated. In this situation,I think owners should settle for a reasonable price.Otherwise, the government should invoke "eminent domain", not-for-profit education being a public purpose enterprise; here, they will get the market price determined by the government with proviso of judicial review.

@lafanga Under the section 4, a government can purchase land for a public welfare project. That's too after a due process. But keep in mind that NUML is a private business. So Imran is totally wrong morally and legally too. But don't worry he will NEVER come into power.

Shaukat khanum is one of the best hospitals which can be compared to any international hospital in the world. NAMl is is doing great job. What it has achieved so quickly is just amazing. I had to spend 50 times more to get a degree/education from UK. How is education/building a university can be a short term approach? Oxford/Cambridge were built 400 plus years ago on the model/principle.

To a great extent, Imran Khan's politics is finished and its his own doing, he provided the opportunities which others cashed, I don't think PTI will come into power, it should not if that's the supremacy they are going to bestow on the people. All politicians are in the same boat as far as a common pakistani is concerned.

First of all, he did not say that KPK government would do that as Mianwali is not in KPK. He said, if we make federal government after the elections, then they could do this under section 4, under which government can compel any one to sell their land for building projects of common good. Secondly, one should not forget that this land was worth nothing before he built the college, it was just an agricultural land but now that the owners know that the college needs it, they are asking for a price as if it was a land in the heart of a big city. It is a blackmail.

Many of the comments sound more stupid than the words of IK. Every government has the right to ask people to sell their land for the fair price. The problem is people think they can exploit such situation and demand high prices instead. Now in every country Govt can ask locals to sell their property, this is the law. If someone doesn't like the law then go live in tribal areas...Even the Govts in West ask locals to sell their property... Recently, Britain wanted to build a fast train track from London to Birmingham and the price they offered to the residents affected was nothing but pennies and others who were near to the line were not offered anything despite they had to bear all the noise & turbulence. Our people for some reason have loyalties with tyrants & not the government.

I am pretty sure that the villagers are demanding an unrealistic price just by seeing the opportunity. Atleast its IK who always speak of some "sections and courts" if he wants something which is quite reasonable. Other party leaders would just send thugs!

I am a PTI supporter, but Imran Khan is WRONG in this case. The land is owned by those people, you cannot force them off it. It is theirs to sell at the market rate. If IK wants the land he should give them a reasonable offer.

@Owais Mangal Some of the Imran Khan's supporters lack any common sense, and call everything that dishonors his majesty as lying. True he is educated and better than the previous looters like the rest in power, but education is not just on degrees or a piece of paper. His conduct lately is so ignorant and conceited that his popularity is badly hurt, whether he realizes or not.

@IA : FYI! following text is copied from the NAML college website: Namal College believes that the education is the right of everyone regardless of their financial background. Generous need based financial assistance is available. Everyone who thinks that he/she can’t afford the above mentioned fee; can apply for financial assistance. 90% of student body at Namal is on some sort of financial assistance ranging from full fee waiver to partial fee waiver.

@Dilectus No need to get emotional on the subject. Both the seller and the buyer have a right to ask for a price. If the deal can be made it will be good. if it is not possible then I am sure the University Administration must have a plan B. As to being on the lighter note, IK has to be very careful of what he says as one wrong sentence no matter whether said in lighter or serious tone can create problems for the party.

Imran Khan seems offensive this time,he may offer a handsome amount,maybe then the owner sells it.Threatening of acquisition via Sec 4 of Land Acquisition Act,will not succumb the owner,he will go to court and have stay order.

The Land Acquisition Act, 1894 is a British era law which governed the process of land acquisition in India until 2013 and continues to do so in Pakistan. It allows the acquisition of land for some public purpose by a government agency from individual landowners after paying a government-determined compensation to cover losses incurred by landowners from surrendering their land to the agency. In India, a new Act, The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, replaced this Raj law. Imran sounds right in this case because the Prices of the Property might have gone up because he established the Namal University there. So he may have all the right to be upset with the owner. Unfortunately for the owner the law has not been modified as it has been done in India. It is not worth fighting with a leader who is working selflessly and the KPK government behind him and he is Just too.

A request to commentators here: Check out " Eminent Domain" in Wikipedia to educate yourselves about the complex issue of land distribution. Or, read John Steinbeck's " Grapes of wrath" to understand how emotive the issue really is? I don't have the faintest idea about land holdings in Pakistan ( from what I understand there has never been a serious effort to address the issue!) ,and educated Pakistanis tapping out their thoughts would be an educational material!:)

@Philosopher (from Japan)" donating your home" IK is not asking the landowners to DONATE their HOME.He is asking them to sell the vacant LAND that is lying adjacent to the University at a reasonable price for expansion of the university. Since they are asking for exorbitant price, which amounts to blackmailing AND land speculation,he is telling them that he would try to acquire the land(for this public purpose) by invoking "eminent domain".Which a legal recourse all over the world.There is nothing wrong with that. Yes, I would be selling my second house to serve public purpose, if it comes to that.It is a big SAVAB. You don't want me to become homeless. Your point regarding BaniGala is highly hypothetical and does not need a response.And BaniGala is not a palace;for palaces you have look elsewhere. Let's confine ourselves to issues and avoid being personal

@Onlooker charity starts from home. If it is sawab to grab others land then start donating your home or banigala palace (10 canal isn't consider palace??). The matter relates to personal property that's why we should see ourselves first rather than pointing fingers on others. They live there before the buildup of university and they have all the rights to sell it at exorbitant prices ( go n read property rights).
